Booking conditions
The booking is made subject to these conditions. If the person making the booking is doing so on behalf of a party then that person must have the authority to accept these conditions on behalf of all members of the party and is responsible for ensuring that each member of the party is kept fully informed of all details of the booking and fully complies with these conditions during the rental period. Each member of the party should read these conditions carefully and contact imagine Montenegro if he/she has any queries.
Booking
Contact imagine Montenegro to confirm the availability and rental fee of your chosen property and any other information important to your booking.
Subject to availability, and on your request, a provisional reservation will be made.
- In order to secure the booking the following must be sent to the company within 5 days of the provisional reservation:
- The booking form, completed in full and signed by a member of the party over 18 years of age, accepting these conditions on behalf of all party members
- A booking deposit of 30% of the total cost. If the booking is made less than ten weeks prior to departure, the full amount will be payable upon booking.
On receipt of the signed booking form and deposit the company will confirm your booking by issuing a confirmation invoice. You should check this carefully as soon as you receive it and contact the company immediately if any information is incorrect or incomplete as it may not be possible to make changes at a later date. A binding contract comes into existence when we despatch our confirmation invoice.
The balance must be paid no less than 10 weeks before departure. If the balance is not received by the due date, we reserve the right to cancel the booking and cancellation charges will apply. Late payments will incur an administration charge of £25.00 or the cancellation of booking and loss of deposit payment. No payment shall be deemed to have been received until the company has received cleared funds.
Bank transfers made from abroad will be required to pay UK bank charges.
Inventory and Security Deposit
A security Deposit is required to cover the cost of any breakage, loss, damage or other abuse of the property, its contents, fixtures, fittings and equipment. This should be sent to us with your balance payment. You remain liable for the full cost of any repairs or replacements required due to accidental or negligent breakage, loss, damage or other abuse of the property which exceeds the amount paid as a security deposit, and we reserve the right to invoice you for the additional amount. You must notify the local agent of imagine Montenegro immediately of any damage, breakage or loss.
Imagine Montenegro may take up to 28 days following the return date to return the Security Deposit to you. Delays can be caused whilst waiting for bills or proof of damage. The company will make any necessary deductions from the security deposit and the remaining balance will be returned with a breakdown of the costs incurred. We reserve the right to hold the security deposit for longer than 28 days following the return date if there is a dispute over the charges incurred, or it is awaiting bills/proof of damage. The Company will notify you in the event of this occurring.
Payment of invoices must be made within 30 days of the date of invoice. If You fail to pay any sum due under these conditions on the due date, the company shall be entitled, without limiting any other rights it may have to charge interest on the outstanding amount at the rate of 2% above the base lending rate from time to time of Barclays Bank Plc accruing on a daily basis until payment is made whether before or after judgment. The company reserves the right to claim interest under the Late Payment of Commercial Debts (Interest) Act 1998.
Use and Condition of Property
Only the people stated in the confirmation invoice may use the property. No other people are permitted to stay in the property unless otherwise agreed with the company and the owner. Unauthorised over-occupancy can result in penalty charges and/or immediate cancellation of the right to occupy the property.
Properties are furnished and equipped for self-catering for the number of people that equates to standard occupancy and will be cleaned and checked before your arrival. If you have any problems or complaints, the local agent of imagine Montenegro should be notified as soon as possible. The accommodation shall be left in the same state of cleanliness and general order in which it was found. We reserve the right to retain money from the security bond to cover additional cleaning costs should the property be left in an unacceptable condition. The client and party acquire no rights whatsoever over the property excepting occupation as a holiday let for the period booked. The client shall not sub-let the property. The property must be kept locked at night and whenever unattended.
We reserve the right to terminate your holiday due to your misconduct or the misconduct of anyone in your party. The client is expected to act in a manner that would not cause unacceptable disturbance to residents in neighbouring properties. All members of a party must behave appropriately at all times and keep noise to a minimum. If the company deems the behaviour of your party to be inappropriate, dangerous or offensive then we reserve the right to terminate the booking with immediate effect and request your immediate removal from the property without refund or compensation. The owner or his/her representative shall be allowed reasonable access to inspect the property prior to the return date and may access the property at reasonable times during the rental period in order to carry out urgent maintenance.
Arrival and departure
The holiday rental period begins at 3pm on the first day of the booking period and ends at 10am on the day of departure. Occasionally the cleaners may not have finished preparing the accommodation by 3pm, in which case we ask for clients' understanding and co-operation in allowing them to complete their work. We reserve the right to deduct supplementary charges from the security deposit if the property is not vacated at the stated time, unless prior agreement has been given.
Insurance
We strongly recommend that you take out comprehensive travel insurance as we cannot accept any responsibility for medical expenses, costs of repatriation, loss or damage to possessions, public liability, personal injury or any other costs, losses or damages of the kind which would be covered by a travel insurance policy. This is your sole responsibility.
Animals
No animals are permitted in any of our properties.
General
- Imagine Montenegro shall not be held responsible for:
- any temporary defect or stoppage in the supply of public services to the property, or in respect of any equipment, machinery, or appliances in the property or garden.
- any loss, damage or injury, which is a result of adverse weather conditions, riot, war, strikes, or other matters beyond the owner's or company's control.
- any loss, damage or inconvenience caused to or suffered by the client if the property is destroyed or substantially damaged before the start of, or during the rental period.
Cancellation
Cancellation by you
You may cancel the Booking in writing at any time. Cancellation must be in writing by lead name and sent by recorded delivery to imagine Montenegro Ltd at 77b St Pancras, Chichester, West Sussex PO19 7LS. Cancellation of accommodation will apply from the date we receive the written cancellation notice. If this is more than 10 weeks before arrival, only the deposit will be retained. If it is less than 10 weeks then 100% of the total cost will be retained. The date of cancellation shall be deemed to be the date on which the company receives written notice of the cancellation. If you are covered by holiday insurance you may be able to recover these cancellation charges.
Imagine Montenegro shall use reasonable endeavours to find a replacement customer for the Rental Period for the Owner. If a replacement is found then the Company will refund the Rental Fee to You, less the Deposit and any difference between the Rental Fee and the fee paid by the replacement customer.
If, after the contract comes into effect, you wish to change any details of the booking (e.g. arrival date or accommodation) we will endeavour to comply. A fee of £20 will be charged for each amendment. In the event that 10 weeks before arrival you wish to alter your arrival date to a later date the cancellation charges will apply.
Cancellation by us
In the very unlikely event that specific accommodation ceases to be available as booked and we are unable to offer you equivalent alternative accommodation we will refund all the money paid (including the deposit).
If cancellation or change by us is brought about by war, threats of war, riots, civil commotion, strikes, disasters, terrorist activities, bad weather, acts of any government or public authority, acts of God or other events outside our control we shall not be held responsible in any way, except to refund any monies already paid in the event of cancellation.
We reserve the right to modify or withdraw any booking due to circumstances beyond our control and cannot be liable for any loss, expense, inconvenience or claim arising there from. Our liability will be limited to a refund of any monies paid to Imagine Montenegro.
Due to the role of the company as an agent, there is a small risk that alterations beyond the our control may occur at short notice. The Company reserves the right to make minor changes to the booking both before and after you have receipt of the confirmation invoice. In such cases the company will endeavour to contact You. You agree and accept that minor differences between the photographs/ texts/ illustrations on the website and the actual property may arise although we take great care to provide accurate information on the property and general area in which it is located. . We will endeavour to inform you of any such changes in advance, although these will not in themselves necessarily entitle you to cancel your booking without the usual penalties. Where circumstances beyond our control necessitate a change in holiday arrangements, we will advise you as soon as possible.
In the unlikely event that the company or the owner makes changes to the booking or cancels the booking then the company will inform you at the earliest opportunity and where possible offer one of the following options: a) to accept the change b) book an alternative property at the current advertised price upon which we shall make a refund in respect of any price difference or c) cancel the booking and receive a full refund of the rental fee.
Complaints
In the unlikely event that you have a complaint or suffer a problem, including maintenance issues or problems which may result in damage to the property, then you must report the complaint in writing immediately to the local agent of imagine Montenegro, who will try to solve the problem. You must also contact the company during your holiday to inform them of any complaint or problem if the local agent has not solved the problem to your satisfaction, so that the company can try to resolve the problem. If the problem was not resolved to your reasonable satisfaction during your holiday you should put your complaint in writing with supporting evidence to the company within 30 days of the return date. We will forward your written complaint to the owner and will within reason liaise with the Owner to assist in reaching a satisfactory settlement for all justifiable complaints regarding the property you may have. However, it is your responsibility to take the complaint up with the owner directly if no satisfactory settlement can be reached. Failure to give the company the opportunity to resolve the problem during the rental period or to follow the procedure set out in this clause will be deemed a waiver of your rights to a refund or compensation.
If you have any complaints regarding any services the company provides , you must inform us immediately in writing and in any event within 7 days of the end of any arrangements booked through us. We regret we cannot accept any liability if we are not so notified. Our maximum liability if we are found to be at fault in relation to any service we provide (as opposed to any service provided by any third party such as an owner for whom we are not responsible) is limited to the commission we have earned or are due to earn in relation to the booking in question.
Liability
Imagine Montenegro acts as a booking agent for the owner of the property. Your contract for the let is with the owner. We accept no liability in relation to any contract you enter into for the property or for any services or arrangements you purchase or for the acts or omissions of any owner or supplier or other person or party connected with any arrangements.
The company shall not be liable for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtration systems, nor for the failure of public utilities such as water, gas and electricity.
Neither imagine Montenegro nor the owner can be held responsible for noise or disturbance originating beyond the boundaries of the property or which is beyond the owner's control. In the event that a source of reasonably obvious noise has been in existence prior to your arrival and we are informed of this, we will contact you to inform you of the disturbance.
Changes to booking conditions
We reserve the right to make changes to the booking conditions at any time with 30 days notice.
Data Protection
It is the company's policy to respect the privacy of its clients. The Company will not disclose the details and information provided by you to any third party unless it is specifically required to do so by law.
By accepting these conditions, you acknowledge and consent that the company may store and process your personal details and information (for example name, address, telephone number and details of the property booked ) in accordance with any data protection legislation in the UK. You acknowledge and consent that the company may send your personal details to the owner and the provider of any additional services or Bespoke Services used during the Rental Period.
These Conditions and any disputes or claims arising out of or in connection with their subject matter are governed by and construed in accordance with the law of England.
The parties irrevocably agree that the courts of England have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Conditions.
